Complaint on selling of wingdocs

Postby Kobus6110 » Fri Sep 07, 2012 8:37 am

I just want to know what is the procedure if somebody is selling the manuals on ebay. I unfortunately bought a set of manuals and when opened I saw the website where manuals are available. Thank you. Kobus6110 :x

Sorry it's on bidorbuy. It is manuals for the Goldwing 1500's and 1800's. It is the same manuals on this site.

Probably not too much you can do. The seller has them and as long as people are buying he's laughing. The complaint should be made at the site where the sales are made. I don't think this site - Goldwingdocs.com - is the seller.

Thanks for the info. I'm going to report it in any case to the site where he is selling from and give him a very bad rating. :x :D

A feedback like - "Selling copyrighted material freely downloaded" may help.

Sorry but there is nothing to be done. Once someone becomes the "owner" of copyrighted materials they can then sell them to another without penalty. This is called the "First Sale Doctrine". Under the first sale doctrine (section 109 of the Copyright Act), ownership of a physical copy of a copyright-protected work permits lending, reselling, disposing, etc. of the item, but it does not permit reproducing the material, publicly displaying or performing it, or otherwise engaging in any of the acts reserved for the copyright holder, because the transfer of the physical copy does not include transfer of the copyright rights to the work. It can be upsetting but it is the rule.

For selling manuals? Seems a bit harsh.

I have to say - did he give you a manual on disk for a minimal amount of money? That would be called value for value. It doesn't matter where he got his base product, he is permitted under the capitalist selling systems to resell it, unless it is copyrighted. And if it is, it still falls under only copyright infringement either way, downloaded or from him on a disk. He has not done anything else wrong. That is what capitalism is all about. Perhaps a little immoral, but who doesn't do slightly immoral things. I caught myself looking at my neighbor lady's butt the other day. Should I be blinded for that? Come on guys. If the original poster had researched prior to buying, he would have found a manual for free. It all falls under the buyer beware warning that needs to be everywhere these days. I have bought things before, and overpaid to have them now instead of when a local store could order them in. It is the same thing. We have to live with this and be either more selective in the future or more careful. End of story. ;)

There's a Latin phrase that covers many online sales: "Cateat Emptor". It means buyer beware. One bad thing that the Internet has fostered is somewhat unscrupulous sellers. It behooves everyone that buys online to be extremely careful on where they spend their money.

I was looking for a manual when I bought the GL. I get one for every vehicle I buy as I do much of the maintenance on them as I'm capable of. I prefer factory shop manuals and finally found one online for under $10 and it was a pdf download of a Honda manual. I was completely satisfied with it. I prefer print, but if I need something to refer back to while I'm in the workshop, I just print the pages I need and all is good. There seems to be quite a few people out there that take the time to copy each and every page of a given manual they obtain and sell the copies on either disc or as a download, usually in pdf format. Printed manuals get scarce as time goes on and they can be expensive when you find them. Haynes and Chilton as well as the others go out of print after a time and get scarce also.

There are many sources for online manuals that at first state that they are free for everything from washing machines to trucks, but end up not being so. These are getting all too common.

And you didn't take a picture of your neighbor to share, MV? How selfish of you.

If a television isn't copyrighted, can I resell one, no matter how I came into possesion of it? No.

The material in question is clearly copyrighted.....which is PDF's of the OEM manuals aren't available here anymore.

For any sale to be legal, the seller has to be the legal, rightful owner.

Expose him for what? Selling?

Or for not cautioning the OP that he can illegaly download the material elsewhere?

No.. but what I'm getting at here is this, I don't wish to buy something from him in the future, if I know who he is there's no way i'd purchase something from him by accident and I would assume nobody else here would either... :D
