driveshaft front boot

is there or should there be gear oil up at the boot and if not where would it be coming from tnx for help

No.

Are you sure it's gear oil? It could be engine oil, and is more likely to be if it's that far up. If you pull the driveshaft, is it covered in gear oil as well?

not loosing engine oil and smell like 80 sae is there a seal to stop gear oil from going up thr tube

yes. I had to replace mine as it would pump the gear oil up the boot and drip when I parked shortly after a ride. Would not leak with the engine running and bike was sitting but would after a ride. It was not engine oil. The seal is on the shaft itself and easy and cheap to replace. When I replaced mine, no more oil leaks from the boot and the bottom of the engine quit being a greasy mess as well. When you do this, lube the splines on the rear wheel with moly 60 before reassembly as well.
