Damage

A tow truck driver caused some ($1200) damage to my bike when he towed it. I had someone in the know document the damage was done from the tow

The tow truck driver denied he caused the body damage & they offered me 50% of the total repair bill.

What would you do?

Take him to court and get a lot more than $1200! Damage + court costs + lawyer fees + lost of service of the bike, while being repaired.

Do you have insurance? Did the insurance company or a roadside service company pay for the tow? I would start by making a claim with them. If not them, then make a claim against the tow service insurance.

Thinking of it (court)

No real proof of anything...just this:

"Damage on left side of the motorcycle was caused by excessive tightening of a tie-down strap which put pressure on the left lower cowl breaking it also the left deflector both broken and the deflector cap is gone due to the others breaking and forcing it to pop off. Estimated cost of replacement parts, some of which are not available from Honda would be 600 US dollars and labor to remove and reassemble would be 2.5 hours."

And where did this dialog come from? Tow company or Honda service provider?

As I said, start with the deep pockets - Insurance, Road side Service, Tow Company. All have lawyers and I think most would rather settle than go to court.

dialogue came from guy who rebuilds them. Was acceptable for possible claim

yes The reason the time lapse is cuz they wanted someone "official" to document damage & I cudn't find anyone w/o paying 100 / hr for 2 or 3 hrs, so after 3 months I finally convinced them to get my GWRRA buddy to do it. Going via the company that dispatches GWRRA Rescue Plus& get them to talk with reluctant tow company. Just very time consuming

UPDATE:

I got my bike towed & the driver damaged it. I had a Goldwing guy (who rebuilds them) take pictures & confirm the damage was done by the tow. The tow driver denies he did it, but the tow company is offering 50 / 50 settlement of the total parts & labour repair & wants a reply within 3 days. (Isn't the offer to settle 50 / 50 an admission of liability?) Any suggestions what to do? I want it fixed right.

If you had an "official" do the evaluation then whomever is going to pay for the damage would have also for the evaluation right? You should have taken it to a Honda Dealer. I'm sure they are official enough. Dragging this out like this may not go well for getting the money to fix the bike.

The Honda dealer wud charge me $220.00 just to tell me what was wrong with it. Neither the tow company or the company that dispatched the tow company would pay for that

I guess I can now take it to a shop for a written estimate. The estimate (now I know what needs fixed) would be free & wud be based on about $120.00 / hr. If they say 3 hrs (or $360) + $800 for parts = $1160.00 & the tow guys gimme 60% of that (or $700), my buddy will charge 40 / hr & is just as good as a shop.

I dunno yet for sure
